Roll-Off Dumpster Rental Agreement

This Roll-Off Dumpster Rental Agreement ("Agreement") is between Dump It KC ("Company") and the customer ("Customer"). By ordering, accepting delivery, or using the roll-off dumpster, Customer agrees to these terms in full.
1. Services & Rental Period
Dump It KC will provide roll-off dumpster disposal service using our containers. Service delivery occurs on the requested day when using online ordering. For same-day swap-out or pick-up, Customer must call at least 4 hours in advance; otherwise, a same-day service fee of $150 applies.
Standard rental period: 3-7 days (included in base price). Additional days beyond purchased days incur a fee of $50 per day until the dumpster is picked up.
2. Dumpster Sizes, Weight Allowances & Overage Charges
All Customers are responsible for the total weight of dumpster contents, scheduling removal, and ensuring no overloading. Customer shall inspect the dumpster upon delivery for existing damage. Upon removal, Company may charge for repair/replacement costs due to damage during Customer's possession.
Exceeding the included weight allowance results in an additional charge of $0.05 per lb (or part thereof). Customer shall not load debris above the maximum tonnage rating — any excess may result in refusal of service and required offloading. Customer is responsible for everything that is placed into the dumpster, including any item added without Customer’s knowledge by neighbors, tenants, contractors, employees, guests, passersby, or any other third party.
- 10-11 Yard — Included: 1 Tons; Max: 9.1 Tons
- 12-13 Yard — Included: 1 Tons; Max: 9.05 Tons
- 15 Yard — Included: 1.5 Tons; Max: 8.9 Tons
- 20 Yard — Included: 2 Tons; Max: 8.75 Tons
Overweight Fee – $0.05 per lb
Landfills charge strictly by weight, not by how full a dumpster looks. When a load exceeds the included tonnage, the landfill bills us for every additional pound. This fee simply passes through those landfill charges so we are not absorbing disposal costs caused by heavier loads. Dense materials such as concrete, dirt, roofing, and shingles add weight very quickly, even when the container does not appear full.
Overage fees are based on certified scale tickets or Company's reasonable estimate. Customer may request to view scale tickets.
3. Additional Fees & Charges
All fees are non-negotiable and will be charged to the card on file. Full list of fees available at: Restricted Item Dumpster Fees & Additional Charges.
- Extra Rental Days – $50 per day
Our dumpsters and trailers are limited inventory. When a unit remains on site beyond the agreed rental period, it cannot be rented to another customer. This fee covers lost availability, scheduling impacts, and additional operational time required for extended rentals. - Restricted Item Fee – Landfill overage based
Certain materials are not accepted by landfills or require special handling. If restricted items are found in your load, the landfill may charge overage fees, reject the load entirely, or require manual sorting before disposal. These charges are billed directly to us by the landfill and must be passed through. Full list: Restricted Items List - Return Item Fee – $75 + $3.00 per mile
If prohibited or restricted materials must be returned to the customer, a $75 return item fee applies, plus $3.00 per mile for transportation. This covers the additional labor, handling, travel time, and cost required to safely return those materials. - Landfill Reload Fee – $150 per hour (1-hour minimum)
A landfill reload occurs when the disposal facility determines that part or all of a load cannot be accepted due to restricted items, contamination, or non-compliant materials. In these situations, we are required to reload the dumpster, separate materials, and make adjustments as directed by the landfill. This fee covers the additional labor, equipment use, and time required. One hour minimum applies. - Onsite Unload Fee – $150 per hour (1-hour minimum)
An onsite unload fee applies when we must return to the customer location and manually unload the dumpster ourselves. This typically occurs when materials must be removed due to restricted items, unsafe loading conditions, or landfill rejection. The fee reflects the labor-intensive nature of unloading debris by hand, as well as the additional time and equipment required. One hour minimum applies. - Additional Haul and Dump Fee – $225 per extra load
A standard rental includes one delivery, one pickup, and one landfill dump. If you need the dumpster unloaded and dumped a second or third time during your rental, each additional trip to the landfill is billed separately.
Each additional haul and dump is $225 and includes up to 1 ton of disposal weight. This fee covers the additional driver time, fuel, equipment use, landfill trip, and scheduling.
If an additional load exceeds 1 ton, the excess weight is billed at $0.10 per pound based on the final landfill scale ticket. - Fuel Surcharge – $3.00 per mile beyond 30-mile radius
Our standard service area includes a 30-mile radius. Travel beyond this range increases fuel usage, drive time, and vehicle wear. Additional mileage beyond 30 miles is charged at $3.00 per mile to fairly cover those added costs. - Cancellation Fee – $50
Applies to cancellations made within 24 hours of the scheduled delivery time. This fee helps cover reserved scheduling, dispatch preparation, and lost delivery availability. - Dry Run Fee – $150
A dry run occurs when we arrive for delivery or pickup and cannot complete service due to blocked access, placement restrictions, HOA rules, site limitations, or if the customer selected a dumpster size that cannot be safely placed at the location. It is the customer's responsibility to ensure the drop-off area is accessible and that the selected dumpster size fits the space and complies with any HOA or property restrictions. If service cannot be completed for these reasons, fuel, labor, and scheduled time have still been used, and the dry run fee will apply. No refunds are issued if we are called to remove the dumpster due to HOA enforcement or other onsite restrictions. - Unsafe Load Fee – $100
Loads that exceed the fill line or create unsafe transport conditions put drivers, equipment, and the public at risk. This fee covers the extra time and precautions required to correct and safely transport the load. - Onsite Popped Tire Fee – $100
Sharp debris, nails, or improper loading can damage tires while the trailer is on site. This fee covers service time and operational impact caused by site conditions. - Tire Replacement Fee – $250
If a tire is damaged beyond repair, full replacement is required. This fee reflects the cost of commercial-grade tires, labor, and downtime needed to safely return equipment to service. - Dumpster Cleanout Fee – $125
This fee applies when materials such as paint, oil, chemicals, or other residue are placed in the dumpster and require additional cleaning. It covers labor, cleaning supplies, disposal of contaminated waste, and downtime needed to return the bin to service.
4. Customer Responsibility for Permits & HOA Compliance
Customer is solely responsible for obtaining any required permits and ensuring full compliance with all local, city, county, state, and HOA regulations regarding dumpster placement, street occupancy, right-of-way use, visibility, time limits, or any other restrictions. 5. Binding Policies
By entering this Agreement, Customer agrees to be bound by all of Dump It KC's policies, which are incorporated herein by reference and form an essential part of this contract, including but not limited to:

6. Waste Material Restrictions
Non-Hazardous Solid Waste Only.
Customer agrees not to place any liquid waste or any waste that is, or contains, radioactive, volatile, corrosive, highly flammable, explosive, biomedical, biohazardous, infectious, toxic, or any hazardous wastes/substances ("Prohibited Waste") into the roll-off container. Prohibited Waste includes, but is not limited to: tires, paint/paint cans, batteries, ashes, oil, vehicle parts, sewage sludge, asbestos, chemicals, Freon-containing appliances, medical waste, propane tanks, fluorescent tubes, etc.
7. Inspection/Rejection & Right of Refusal
Title to and liability for Prohibited Waste remains with Customer. Dump It KC has the right to inspect, analyze, and/or test any waste. Company reserves the right to refuse delivery, service, or pickup at any time for safety, access, compliance, prohibited materials, overloading, or any valid reason. If refused after arrival (including no-show, blocked access, unsafe conditions, prohibited items, or placement issues), a $150 Right of Refusal / Dry Run Fee applies, plus any applicable additional fees (e.g., onsite unload, reload, unsafe load, etc.).
8. Site Access, Property Damage & Acknowledgement
Customer grants safe/legal access and confirms the site/driveway/lawn/path is suitable for delivery, placement, and removal of the roll-off dumpster. Customer acknowledges that Dump It KC shall not be liable for damage to driving surfaces, landscaping, pavers, concrete, utilities, or structures resulting from normal operations (unless due to Company's gross negligence). Customer is not allowed to move or reposition roll-offs with personal equipment or third-party equipment.
9. Payment Terms & Optional Add-Ons
Prepayment at reservation is required by debit/credit card; Dump It KC will keep the card on file until the account reaches zero balance. Additional charges (overages, fees, damages) are due upon pickup or invoicing.
Optional Insurance Add-Ons
At the time of rental, Customer may elect to purchase the following optional protection add-ons. These are not required and do not replace Customer's overall responsibility for proper use and care of the dumpster.
- $89 Bin Insurance
Protects against incidental interior and exterior damage including dents, scrapes, and minor repairs that do not put the dumpster out of service.
Does NOT cover: Major structural damage, damage from overloading, prohibited materials, fire (unless Fire Insurance is also purchased), theft, loss, defacement, graffiti, vandalism, intentional damage, or any damage that renders the dumpster unusable or requires full replacement.

Covers internal dumpster fires including cleanup and minor fire-related surface damage that does not put the dumpster out of commission.
Does NOT cover: Fires caused by prohibited materials, major structural fire damage, total loss of the dumpster, or fires that put the dumpster out of service for extended periods.

These add-ons are internal protection plans offered by Dump It KC. Coverage is subject to the terms outlined in the linked policies. Customer should review the full policy details before purchase.
Customer Responsibility for Damage Beyond Insurance
Even if insurance is purchased, Customer remains fully responsible for any damage, theft, loss, defacement, or vandalism that falls outside the limited scope of the purchased add-on. In such cases, Customer will be billed the full replacement or repair cost according to the Damaged Dumpster & Add-On Fees schedule at https://dumpitkc.com/damaged-dumpster-addon-fees.
Optional Add-On Items & Damage/Loss Replacement
Customer may elect to rent optional add-on items (tarps, locks, ramps, doors, etc.) at the time of rental. These items are provided in good condition and remain the property of Dump It KC.
Customer agrees to return all add-on items in the same condition as received, normal wear excepted. If any add-on item is lost, stolen, damaged beyond normal wear, or not returned, Customer will be charged the full replacement cost as listed on the Damaged Dumpster & Add-On Fees schedule at https://dumpitkc.com/damaged-dumpster-addon-fees.
Customer acknowledges that replacement fees are non-negotiable and will be charged to the card on file. These fees cover the cost of replacement materials, labor, downtime, and administrative processing. Customer is responsible for securing add-on items against theft or loss during the rental period.
10. Unauthorized Dumping by Third Parties
Customer is responsible for the contents of the dumpster at all times while it is in their possession. If third parties (neighbors, passersby, contractors, or others) deposit materials into the dumpster without Customer's permission ("unauthorized dumping"), Dump It KC is not responsible for removing those items. Customer will be solely responsible for any additional weight charges, overage fees, restricted item fees, cleaning fees, or disposal costs resulting from unauthorized dumping. If the unauthorized material requires off-loading or a separate trip, the applicable Onsite Unload Fee or Landfill Reload Fee will also apply.
11. Restricted Items & Associated Fees
If restricted or prohibited items are discovered in the dumpster (including but not limited to those listed in Section 6), Dump It KC reserves the right to:
- Refuse the load and apply the applicable Right of Refusal / Dry Run Fee ($150), plus any additional fees (e.g., Onsite Unload Fee, Landfill Reload Fee), or
- Bill Customer for the restricted item fees charged by the landfill (passed through at cost), or
- Return the restricted items to Customer (if safe and feasible), and charge the Return Item Fee ($75 + $3.00 per mile) plus any applicable labor, transportation, or disposal costs.
Customer is solely responsible for all costs, fines, penalties, or surcharges resulting from restricted items in the load. Full list of restricted items and associated fees: Restricted Item Dumpster Fees.
12. Indemnification & Liability Waiver
Customer agrees to indemnify, defend, and hold harmless Dump It KC, its owners, employees, agents, and insurers from any claims, damages, fines, losses, or liabilities arising from Customer's use of the dumpster, site conditions, prohibited materials, overloading, or negligence.
13. Force Majeure & Other Terms
Dump It KC is not liable for delays or non-performance due to events beyond reasonable control (e.g., weather, road closures, landfill issues). This Agreement is governed by Missouri law. Disputes shall first be submitted to binding arbitration under AAA Commercial Rules in Jackson County, Missouri. Parties waive jury trial rights. Prevailing party recovers attorney fees/costs.
14. Company Insurance
Dump It KC maintains commercial general liability and automobile liability insurance (including trailer coverage). Certificates available on request. Insurance does not cover Customer items, site conditions, or Customer negligence. No workers' compensation insurance is maintained.
15. Severability & Entire Agreement
Severability: If any provision is invalid, the remainder remains in effect.
Entire Agreement: This is the entire agreement; no oral modifications.
16. Overweight Overage Authorization Hold
For each roll-off dumpster rental, Dump It KC places a $200 authorization hold on the Customer's debit or credit card on file. This hold is specifically for securing payment of any overweight overage charges that may be determined after the rental when the load is weighed at the landfill.
This is an authorization hold only. Dump It KC does not actually charge, capture, or take any money from the Customer's account when placing or maintaining this hold. The funds remain in the Customer's account and are only reserved for potential use.
If there are no overweight overages (i.e., the final weight is within the included tonnage allowance for the rented size), the $200 authorization hold will be released immediately at the close of the booking, typically upon pickup and confirmation of the final scale weight.
If overweight overage charges are incurred, the actual fee due under Section 2 will be captured from the held funds. Any remaining hold balance will be released. The Customer remains responsible for any overage amount that exceeds the $200 hold, which will be charged to the card on file pursuant to Section 9.
Acknowledgement & Electronic Signature
This Agreement, together with the booking confirmation, constitutes the entire agreement between the parties and supersedes all prior understandings. By completing the booking form, checking the agreement box, or signing (electronically or otherwise), Customer acknowledges that they have read, understood, and agreed to all terms above, confirms they are 18 years of age or older, and are authorized to bind the property and/or party.
